Privacy Policy

The Bamboo Ide8 Insurance Services, LLC and its subsidiaries and affiliates (hereinafter, “Bamboo”, “we”, “us”, “our”) believes the information that we collect about visitors to our website(s), customers, potential customers, and proposed insureds (referred to collectively in this Privacy Policy as “customers”) must be treated with the highest degree of confidentiality. For this reason, and in compliance applicable laws and regulations, including but not limited to  the Title V of the Gramm-Leach-Bliley Act (“GLBA”) and the California Insurance Information and Privacy Protection Act, California Consumer Privacy Act, as amended by the California Privacy Rights Act, we have developed a Privacy Policy that applies to all of our companies.. All individuals with access to personal information about our customers are required to follow this policy in order to assure the confidentiality of the personal information we collect and in order to comply with applicable laws.

Our Privacy Promise 

Your privacy and the confidentiality of your business records are important to us. Information and the analysis of information is essential to the business of insurance and critical to our ability to provide you excellent, cost-effective service and products. We understand that gaining and keeping your trust depends upon the security and integrity of our records concerning you. 

Accordingly, we promise that: 

  • We follow strict standards of security and confidentiality to protect any information you share with us or information that we receive about you; 
  • We verify and exchange information regarding your credit and financial status only for the purposes of underwriting, policy administration, or risk management, and only with reputable references and clearinghouse services; 
  • We only collect and use the minimum amount of information about you and your business necessary to advise you about and deliver to you excellent service and products, and to administer our business; 
  • We train our employees to handle information about you or your business in a secure and confidential manner and only permit employees authorized to use such information to have access to such information; 
  • We do not disclose information about you or your business to any organization outside Bamboo Ide8 Insurance Services LLC group of Companies or to third-party service providers, unless we disclose to you our intent to do so or we are required to do so by law; 
  • We do not disclose medical information about you, your employees, or any claimants under any policy of insurance, unless you provide us with written authorization to do so, or unless the disclosure is for any specific business exception provided in the law; 
  • We will attempt, with your help, to keep our records regarding you and your business complete and accurate, and will advise you on how and where to access your account information (unless prohibited by law), and will advise you on how to correct errors or make changes to that information; and 
  • We audit and assess our operations, personnel, and third-party service providers to assure that your privacy is collected, maintained, and used in accordance with this policy and applicable laws. 

 

Information Collected 

For purposes of our Privacy Policy, the term “personal information” includes all information that identifies you personally that we maintain in a personally identifiable way and is not otherwise available to the public, and “sensitive personal information” includes, but is not limited to, social security numbers and other governmental identification numbers, financial account credentials, racial and ethnic origin, and health information.  

The types of sensitive and personal information we may collect and share depend on the product or service you have with us. This information may include: 

  • Your name, including as it appears on your driver’s license, address, telephone number, date of birth, driver’s license number, and social security number; 
  • The name(s), date of birth, and driver’s license number of household members over the age of 14, if applicable; 
  • Credit card or banking information, including, but not limited to, credit score and credit history; 
  • Loan records; 
  • Assets; 
  • Credit-based insurance scores, insurance claim history; 
  • Criminal history and police records; and 
  • Employment information; 

 

Collection and Sources of Information 

We collect only personal information that is necessary for (a) determining eligibility for the product or service; (b) administering the product or service obtained; and (c) advising about our products and services. The information we collect generally comes from the following sources: 

  • Submission – During the submission process, you provide us with information about you and your business, such as your name, address, phone number, e-mail address, and other types of personal identification information. 
  • Quotes – We collect information to enable us to determine your eligibility for the particular insurance product and to determine the cost of such insurance to you. The information we collect will vary with the type of insurance you seek. 
  • Transactions – We will maintain records of all transactions with us, our affiliates, and our third-party service providers, including your insurance coverage selections, premiums, billing, and payment information, claims history, and other information related to your account. 
  • Claims – If you obtain insurance from us, we will maintain records related to any claims that may be made under your policies. The investigation of a claim necessarily involves the collection of a broad range of information about many issues, some of which do not directly involve you. We will share with you any facts that we collect about your claim, unless we are prohibited by law from doing so. However, please be aware that the process of claim investigation, evaluation, and settlement also involves the collection of advice, opinions, and comments from many people, including attorneys and experts, to aid the claim specialist in determining how best to handle your claim. In order to protect the legal and transactional confidentiality and privileges associated with such opinions, comments, and advice, we will not disclose this information to you. 
  • Credit and Financial Reports – We may receive information about you and your business regarding your credit. We use this information to verify the information you provide during the submission and quote processes and to help underwrite and provide to you the most accurate and cost-effective insurance quote we can provide. 
  • Third-Party Sources – We may also receive information about you from third parties including, insurance support organizations that assemble or collect information about individuals for the purpose of providing to insurance companies.  This type of information may include, but is not limited to, claims history and credit information.  Insurance support organizations may keep information they give us. These firms may share that information with other persons as permitted by law.  We use this information to verify information you provide during the submission and quote processes and to help underwrite and provide to you the most accurate and cost-effective insurance product we can provide. 
  • Online User Information – We collect online user information to support your use of our website, to improve our products and to develop our products.  For example, we may capture data input, scrolling, mouse movements, and client-side errors on Bamboo websites in order to improve Bamboo products and customer experience, and may view this information on an individual session basis through logs and visually recreated user sessions.  We also use the data to operate our business, which includes analyzing our performance, meeting our legal obligations, and doing research. We restrict access to information about you to those employees who need to know that information to provide products or services to you. We may also, in certain circumstances consented to by you and/or permitted by law, disclose information about you to third parties. We maintain physical, electronic, and procedural safeguards to protect your information. 

 

Storage, Sharing and Disclosing of Personal Information 

We maintain physical, electronic, and procedural safeguards and security measures that comply with federal and state laws to protect your personal information. We restrict access to your personal information to those individuals, such as our employees, agents, and service providers, who are contractually bound to keep this information confidential, agree to safeguard your personal information and who need that information to serve you or to assist us in conducting our operations. We retain personal information only as long as required by our business practices and applicable law.  

We maintain procedures to assure that we do not share personal information with an unaffiliated third party, unless such sharing is permitted or required by law. Personal information may be disclosed to an unaffiliated third party for necessary servicing of the product or service, or for other normal business transactions as permitted or required by law. We do not disclose personal information to any unaffiliated third party for servicing purposes or joint marketing purposes, unless a contract containing a confidentiality or non-disclosure provision has been signed by us and the third party. Unless a consumer consents, we do not disclose consumer credit report type information obtained from an application or a credit report to any unaffiliated third party for the purpose of serving as a factor in establishing a consumer’s eligibility for credit, insurance or employment. “Consumer credit report type information” means such things as net worth, creditworthiness, solvency, etc. We do not disclose to any unaffiliated third party a policy or account number for use in marketing. We may share with our affiliated companies information that relates to our experience and transactions with the customer. 

We do not disclose any non-public personal information about you except as described in this notice or as otherwise required or permitted by applicable law. 

You have the right to prohibit the sharing of your “non-public” personal information with third parties for marketing purposes. If you choose to exercise this right, you may communicate with us by any one of the following convenient methods:

Policy for Personal Information Relating to Nonpublic Personal Health Information 

We do not disclose nonpublic personal health information about a you unless  authorization is obtained from you,, subject to certain exceptions, such as when disclosure is required for certain insurance functions, including, but not limited to, claims administration, adjustment and management; detection, investigation or reporting of actual or potential fraud, misrepresentation, or criminal activity; underwriting; policy placement or issuance; loss control;, and auditing. 

Access to Your Information 

Our employees, employees of our affiliated companies, and third-party service providers will only have access to the information we collect about you and your business as necessary to effect transactions with you. We may also disclose information about you as necessary to fulfil our obligations or as legally required to the following categories of person or entities: 

  • Your independent insurance agent or broker; 
  • An independent claim adjuster or investigator, or an attorney or expert involved in the claim; 
  • Persons or organizations that conduct scientific studies, including actuaries and accountants; 
  • An insurance support organization; 
  • Another insurer if to prevent fraud or to properly underwrite a risk; 
  • A state insurance department or other governmental agency, if required by federal, state, or local laws; or 
  • Any persons entitled to receive information as ordered by a summons, court order, search warrant, or subpoena. 

 

Rights of Access, Correction, Deletion and Limited Use of Information 

You have the right to request access twice in a 12-month period to the personal information that we record; to know the source of the information and the identity of the persons, institutions or types of institutions to whom we have disclosed such information in the preceding 12 months; to request a correction of inaccurate information, or deletions of your personal information (subject to certain exceptions); and to limit the use of your sensitive personal information. Please be aware that we do not control the personal information about you from other third parties such as, consumer reporting agencies or Department of Motor Vehicles. You will need to contact these third parties directly to correct your personal information. We will provide you with the name and address of these third parties upon request. The procedures that you must follow to request access to or an amendment of your information are as follows: 

  • To request access, or correction or deletion of your personal information, please email customerservice@bambooinsurance.com or call (833) 922-6266. The request should include your name, address, telephone number, and the information to which you would like access, corrected, or deleted, and the identity of the document containing the information. Upon receipt of your request we will contact you within 45 calendar days (subject to extension by written notice) to either (a) arrange delivery of the copies that you have requested; (b) to notify you that we have made the correction or deletion; or (c) notify you that we have not made the correction or deletion, and the reason we are unable to do so, for which you will have an opportunity to challenge. 

Mobile/SMS Texting Marketing & Communications  

By opting-in to receive text messages from us or by sending us an initial text message, you agree to receive recurring text messages (i.e., SMS and/or MMS messages) from Bamboo. Some content of the text messages may be considered marketing or advertising and will be sent from us using an auto-dialer system or automated telephone dialing system, also known as “ATDS” (see Auto-dialer systems section for more information). You also acknowledge that you are the owner or authorized user of the mobile number that you provided to Bamboo, and that you are authorized to approve any potential applicable charges and rates resulting from such SMS or MMS messages as message and data rates may apply. You accept that you, and not Bamboo, hold responsibility for all messaging and data charges that may apply. Please contact your wireless carrier for information about your messaging and data plans. Bamboo and your wireless carrier are not liable for delayed or undelivered messages. Message frequency may vary. Providing consent to receive text messages from Bamboo is not a condition of purchase.   

The information we obtained from you through SMS or MMS messages may include your cell phone number, your carrier’s name, and the date, time, and the content of any text messages that you send us. We reserve the right to use this data in the same manner as other data that we may collect from you in alignment with this Privacy Policy, including without limitation, to provide the services you request of us, and to otherwise operate, develop, and improve the service.  

Auto-dialer systems 

Bamboo uses ATDS to deliver text message communications and marketing. Such systems include Sitejabber (to request and collect client reviews), AgencyZoom (our Customer Relationship Management platform), and our text/VoIP system. 

Bamboo Communications Opt-Out Policy 

You are able to opt-out from receiving communications from Bamboo Insurance, such as, but not limited to, email and SMS/MMS messages. Please reach out to Bamboo at hello@bambooinsurance.com to facilitate such request. Additionally, opt-out opportunities will be presented on most of the various outlets from which we send communications and marketing. An Unsubscribe option will be in the footer of all emails sent for marketing and advertising. For text messages, reply STOP or complete this webform to opt-out from receiving further communication via text messaging. For phone calls, please email your opt-out request to hello@bambooinsurance.com.   

Please allow 7-10 business days to process your request. However, please note, even if you opted-out of receiving text messages, emails, or communications from us, we may still contact you for transactional or informational purposes, such as information regarding your policy with us.  

Changes to this Privacy Policy   

We will review and revise our Privacy Policy and procedures to ensure that we remain compliant with all state and federal requirements.
